An Alabama man says he was issued a ticket in Cobb County last week for snacking on a just-bought burger while he was behind the wheel, WSB-TV reports.

“The officer explained to me that he observed me eating a burger for two miles,” Turner said. “He said specifically three times, you can’t just go down the road eating a hamburger.”

The officer wrote him up under Georgia’s distracted driving law, saying Turner was “eating while driving” in the ticket’s comments sections. Turner said he was munching on a double quarter pounder from McDonald’s when he was pulled over.

Turner’s attorney, William Head, told WSB-TV that Georgia’s distracted driving law is vague. A spokesman for Cobb County police declined to comment to the affiliate, citing the ongoing investigation.

Turner is due to appear in court on Feb. 3.
