Former Federal Prosecutor Sam Winder of Albuquerque: “Justice was dealt a severe blow on July 5, 2016”

I first met Sam at Cross of Hope Church in Albuquerque on National Day of Prayer in 2012. Here is Sam Winder’s commentary on FBI Director Comey’s decision regarding Hillary Clinton:

I did not want to comment on FBI Director Comey’s decision yesterday. And I had not had the chance to read his full statement. First, I have respect for Director Comey, I met him several years ago when I was a federal prosecutor. However, I respectfully believe that he should have submitted the case to the United States Department of Justice for a final decision as to whether “a reasonable prosecutor” should have pursued charges. Director Comey is a former prosecutor and his job is to investigate and not prosecute. The language in his statement suggests that other similarly situated individuals might suffer consequences for similar conduct. However, what is NOT similar here is that Hillary Clinton is the presumptive nominee who was the Secretary of State for the President who nominated an Attorney General who was nominated by Hillary Clinton’s husband to be a United States Attorney for the Eastern District of New York. As a federal prosecutor, I worked on hundreds of cases with FBI Agents. I worked with the agents daily with regard to facts that needs to be analyzed and information that needed to be pursued. In addition, matters where presented to a federal grand jury in certain cases. Federal prosecutors have tremendous power to influence how an investigation and prosecution can proceed – and THIS is where politics injected itself into the process. AND, the timing of this matter could not be more suspicious. Bill Clinton meets with the Attorney General last week on her plane for 30 minutes (and who honestly thinks the investigation was not discussed – and Bill knew that the DOJ would not pursue an indictment). On Saturday, Hillary Clinton was interviewed to close the investigation. AND then the FBI Director Comey makes his decision on July 5th (my birthday so I will never forget the date of the decision). One would think it would take more that a mere three days to analyze her 3.5 hour testimony with the hundreds of interviews and the other matters associated with a year investigation in more that just three days. Candidly, I never thought the US Department of Justice- under an Obama appointed Attorney General would ever recommend an indictment be presented to a federal grand jury (but I had a glimmer of hope). However, what surprised me is that the FBI Director would have a press conference announcing he would not recommend prosecution. And as much as I respect the FBI Director — this is also where politics may have crept into the process. Specifically, he knew the DOJ would not present an indictment to a federal grand jury. When I was federal prosecutor, FBI Agents knew when a case was not going to be pursued. I have little doubt that the federal prosecutors (or Lynch) told the FBI there was no evidence to pursue charges – and Director Comey “stole the thunder” knowing that EVEN if an recommendation was presented for prosecution, ultimately the DOJ would not present an indictment to a federal grand jury. In his prepared statement, Comey set forth the gross negligence in this matter with regard to important matters of security. Sadly, Justice was dealt a severe blow on July 5, 2016. Yesterday was a sad day for America and for the Rule of Law….
