DOJ Special Prosecutor’s Report Finds That President Biden “Willfully” Disclosed Classified Documents – No Prosecution Will Be Sought

The Associated Press (“AP News”) reports that the U.S. Department of Justice’s (“DOJ”) Special Counsel, Robert Hur, today released an investigative report finding that President Joe Biden “willfully” retained and disclosed highly classified materials while he was a private citizen (following his tenure as vice president).  Despite this, Hur announced that he will not recommend the filing of criminal charges against Biden or anyone else involved.

Hur’s investigative report includes a harshly critical assessment of Biden’s handling of sensitive government materials, but also details the reasons why he should not be charged with the crime.

A portion of the report discusses Biden’s handling of classified documents regarding Afghanistan, which were retained in his Delaware home and included documents with “Top Secret/SCI” classification markings found in Biden’s garage.

ABC News is also reporting on this matter, writing that it was Hur’s view that at trial, Biden could come across as sympathetic, but forgetful and not capable of the willfulness required to convict.  The report stated that “[w]e have also considered that, at trial, Mr. Biden would likely present himself to a jury, as he did during our interview of him, as a sympathetic, well-meaning, elderly man with a poor memory.  It would be difficult to convince a jury that they should convict him — by then a former president well into his eighties — of a serious felony that requires a mental state of willfulness.”

Biden’s attorneys blasted Hur’s characterization of the president’s memory and recollections during his two-day interview with investigators in October 2023.

My brothers and sisters, this news certainly is not surprising, given the current manner of operation of the DOJ.  That said, maybe this finding and the forgoing of prosecution will help to tamp down and bring some sanity into the never ending efforts to weaponize, or at the minimum to misuse, our federal law enforcement agencies to:  1) support or thwart U.S. policy; 2) affect the success or failure of certain elected officials based upon ideology; and 3) diminish or destroy the necessary impartiality and neutrality when meting out justice, which negatively affects our entire federal justice system, as well as our state judicial systems by precedent or example.

This writer finds Hur’s comments characterizing Biden’s ability (or lack thereof) to successfully defend himself or come across as mentally competent in front of a jury to be sad, remarkable, illuminating and affirming of what many have observed for years.  As a reminder, the report says that the president was “forgetful and not capable of the willfulness required to convict” and that “[i]t would be difficult to convince a jury that they should convict [Biden]…of a serious felony that requires a mental state of willfulness.”

Regardless of the raw politics of it all, the president of the United States (“POTUS”) is our commander-in-chief (including responsibility for potential use of nuclear weapons) and has responsibility for establishing foreign policy.  In fact, the POTUS is traditionally known worldwide as the “leader of the free world.”  It should be obvious by now that U.S. political parties are not the answer to the country’s troubles.  I’ll leave it at that for now!

We should pray that our elected and appointed government officials would begin to acknowledge the difficulties and gross political contradictions surrounding us.  We may have reached the point where compassion and wisdom require an action regarding a leader that is unpalatable to many.

Pray for the wisdom of God (not the wisdom of the world) to guide, direct and inform the hearts and minds of our leaders during this very dangerous and politically-charged period in the United States and the entire world.  As I’ve said time and time again, the answer to our troubles is not found in the wisdom of the world, but in the wisdom of God.  The Answer is and shall always be, JESUS!
