PRESS RELEASE: NM Senate Republicans Condemn Senate Passage of House Bill 7

Parental Involvement and Conscience Protection Amendments Rejected

SANTA FE – Today, the Senate passed House Bill 7 on a 23-15 vote with all Republicans voting against the measure. The bill seeks to override any current and future attempts to restrict abortion at the local level. The bill also enshrines “gender-affirming” care in law and would coerce all public bodies and persons acting on behalf of public bodies to facilitate requests for abortions and gender transitions.

During the debate, Senate Republicans introduced several amendments that were all rejected, including protections for babies who survive abortions; requiring ultrasounds for women; protecting conscience-based decisions for medical professionals; and requiring parental notification for minors seeking abortions or gender transition procedures.

“The progressives of the legislature have no interest in doing what is right,” said Senator Bill Sharer (R-Farmington).  “Senate Republicans introduced simple amendments that would have taken into consideration what is just and what is legal. Instead of hearing our many concerns, they instead enacted a problematic and legally questionable bill into law at the behest of the radical left.”

The bill would also prohibit public bodies that facilitate abortions or gender transitions from consulting with the parents of a minor requesting these services.

“Our future is entirely invested in the very thing this bill attacks—the family,” said Senator Crystal Diamond (R-Elephant Butte). “Unplanned pregnancies and gender dysphoria are some of the most difficult things a child could face. To keep the parents in the dark on these difficult situations is the greatest disservice to that struggling child we could make.”

House Bill 7 will now return to the House of Representatives for concurrence.

BREAKING: Nation’s Most Radical Infanticide, Transgender, and Abortion Mandate Bill Passes NM Senate.

HB 7 Amended in Senate Judiciary, Final Concurrence Vote in House Expected Later This Week.

Santa Fe, NM — Today, in a vote of 23 – 15, the New Mexico Senate passed radical HB 7 which mandates public institutions and employees facilitate and participate in sex-reassignment procedures, abortions and other forms of “reproductive” and “gender-affirming” procedures. Additionally, the bill includes language that mirrors radical post-birth infanticide language from California and Maryland bills. Every Republican Senator voted against the inhumane proposal.

“Today was a tragic day for our state as a majority of New Mexico Senate Dems voted in favor of radical HB 7’s unscientific infanticide, abortion and transgender mandate,” said Elisa Martinez New Mexico Alliance for Life Executive Director. It’s really shameful that the bill sponsors misled the public throughout this process, until today, Senator Duhigg admits HB 7 is indeed a mandate and aims to “change behavior” regardless of conscience objections, long term health impact and parent’s rights.”

A BIG THANK YOU TO ALL WHO VOTED NO ON HB 7, AND ALL WHO SIGNED AND SHARED OUR PETITION. STAY TUNED ON WHAT YOU CAN DO TO FIGHT BACK NEXT!

Numerous amendments were offered by Republican Senators to address the serious concerns contained in the bill. Senator William Sharer, (R-San Juan) offered the first amendment on the floor to remove the term, “perinatal,” from the definition of Reproductive Health Care in Section 2C, “They used the same term, ‘perinatal’ in the California infanticide bill – that word is there on purpose,” said Senator Sharer. “It boggles my mind why we would even consider this, I’m here today because of my need to protect little innocent humans who need love. They don’t need a needle with some kind of poison, they need love.”

The legalized infanticide portion of HB 7 in section 3C mirrors language of the radical California and Maryland bills that shocked the nation. In an effort to deceive the public, the abortion lobby behind this bill tried to sneak in the operative term, “perinatal” into another section, 2C of the radical bill. Perinatal as defined in legal terms, encompasses 28 days after birth. In fact, Minority Leader, Senator Greg Baca noted in a Senate Judiciary hearing the bill as written, opens the door for legalized infanticide by removing “criminal liability or penalty,” based on actions or inaction with respect to their pregnancy that are “actual, potential, or alleged pregnancy outcome.”

Senator and Dr. Gregg Schmedes (R – Bernalillo), the only practicing medical professional in the New Mexico legislature offered vigorous debate on the preponderance of evidence across Europe that contradicts claims made by the bill’s sponsors, including a 15K person study from now defunct Tavistock Institute, the world’s leading gender affirming clinic, “The largest transgender clinic in the world is now closed because the affirming model was found to disproportionately harm teenage girls, gay children and people with autism.”

Other amendments from Senator Diamond (R-Sierra) addressed a parental involvement requirement, Senator Gallegos (R-Lea) to allow abortion-minded women to view an ultrasound, Dr. Schmedes to restore conscience protections and Senator Pirtle to remove certain court fees were all voted down by a majority of Democrat Senators.

The radical bill amended in the Senate Judiciary committee now heads back to the NM House for a concurrence vote expected later this week. It is expected to be signed into law by Governor Michelle Lujan-Grisham.

HB 7 will pave the way for a host of permanent and semi-permanent transgender procedures to be offered without parental consent at public school clinics across the state.

TAKE ACTION TO STOP RADICAL ANTI-LIFE BILLS:

SB 397 – School Based Clinics Operation and Creation. This legislation seeks to increase funding for school based health clinics and expands access to abortion and gender affirming procedures on school grounds. This legislation also allows sexual activity related youth services to occur without parental consent. SB 397 opens access to radical medical procedures on students in schools without permission from consenting adults — including transgender procedures. Read NMAFL’s exclusive analysis on School Based Health Clinics. Please plan to testify against SB 397 on MONDAY.

SB 13 – The Reproductive and Gender Affirming Health Care Protection Act Hearing in Senate Judciary most likely tomorrow at 1:30 PM. SB 13 eliminates interstate regulation allowing out of state minors to travel to New Mexico to receive traumatic, irreversible abortions and radical gender affirming care. This legislation also denies parental access to medical records and puts the very health of our youth at risk. SB 13 passed Senate Judiciary committee on a 5 – 3 vote. MORE ANALYSIS HERE.
