Scoring a major win for liberty and the first amendment, a California court has overturned $300,000 in fines levied against Calvary Chapel of San Jose for failure to stop meeting during the 2020 shutdown.
In a 36-page ruling, Judge Peter Kirwan found the plaintiffs, including the People of the State of California, the County of Santa Clara, and County Health Officer Sara Cody, violated the first amendment, which guarantees the right to freedom of religion and assembly.
The plaintiffs accused Calvary Chapel of violating the unlawful order forbidding an indoor Christmas Eve service in 2020 and a burdensome plan for risk reduction during the pandemic.
