Republican Senators Respond

SANTA FE – After a two-hour long delay and a hearing marred by technical difficulties and limited public participation, the “virtual” Senate Health and Public Affairs Committee today voted along party lines to repeal New Mexico’s abortion law. Senate Bill 10, sponsored by Democratic Senator Linda Lopez (District 11-Bernalillo) and others, would strike an entire section of law that among other things protects medical professionals from being forced to participate in abortions and requires that abortions be performed by licensed physicians.

“Though some of the existing law is unenforceable because of Roe v. Wade, this statute contains important provisions that protect our doctors, nurses, and other medical professionals,” said Senator Gregg Schmedes (District 19-Bernalillo, Sandoval, Santa Fe, and Torrance).” As a medical doctor, I have heard from many of my colleagues that if they lose these vital conscience protections, they will consider leaving the state which would threaten healthcare access for many New Mexicans.”

The current law includes protections from recriminatory action when a hospital or their staff decline to perform abortions based on “moral or religious grounds.” In 1973, the New Mexico Court of Appeals declared this section of the law to be constitutional and a 1990 New Mexico Attorney General Opinion further reiterated its constitutionality.

“A total repeal of New Mexico’s abortion law is not the solution,” added Senator Crystal Diamond (District 35-Dona Ana, Hidalgo, Luna, and Sierra). “In addition to keeping the conscience clause intact, we should be working to strengthen, not weaken standards of care for women. The thought that a non-physician would be allowed to perform a dangerous, late-term abortion on a minor child without any parental knowledge is unconscionable. That is the type of scenario we are exposing women to if this bill passes.”

Senate Bill 10 advanced from the Senate Health and Public Affairs Committee on a 5-3 vote with all three Republican Senators, Gregg Schmedes, David Gallegos, and Stuart Ingle, voting in opposition. The bill will now be referred to the Senate Judiciary Committee where it could be heard as early as next week.

The radical abortion lobby behind SB 10 seeks to strip New Mexico’s 1969 criminal abortion statute and not replace it with ANY protections for women, babies and health care professionals. SB 10 will force the following:
1) Codify abortion up-to-birth in state law.
2) Remove the state’s only conscience protection, forcing medical professionals to perform/assist in abortions since there are no other explicit state or federal conscinece protections preventing this.
3) Does not add any protections for women, but further empowers abortion businesses with less accountability.
5) Forces NM taxpayers to continue to fund healthy moms to abort a healthy baby up to 9 months of pregnancy through state Medicaid.
6) The majority of Americans and the majority of New Mexicans support a limit on abortion after 5 months.

New Mexico Alliance for Life first reported the radical abortion lobby groups behind HB 51 and now SB 10 openly called for the removal of “religious refusals”—removing the option for medical professional or hospital to refuse to perform abortions.

From the beginning of our nation, our founders prayed, sought and fought for a culture that embodied, embraced, and encouraged LIFE. In our Declaration of Independence, we all agree as citizens of the United States, that “We hold these truths to be self-evident: that all men are created equal; that they are endowed by their Creator with certain unalienable rights; that among these are life, liberty, and the pursuit of happiness.”  These founding sentiments were focused on the LIFE that can only be ‘endowed by their Creator,’ the one described in the Holy Bible, the Word of God – the LIFE that only Jesus can give.

January 29th is the date for this year’s National March for Life. Millions have marched in our nation’s capital in years past, and millions will join this year’s virtual march because, as their website reflects, “We march because we envision a future world where the beauty and dignity of every human life are valued and protected – and we promote the beauty and dignity of every human life by working to end abortion—uniting, educating, and mobilizing pro-life people in the public square.”

In light of the fact that we are in the midst of a pandemic which may be peaking, and in view of the heightened pressures that law enforcement officers and others are currently facing in and around the Capitol, this year’s March for Life will look different. The annual rally will take place virtually and March for Life is asking all participants to stay home and to join the March virtually. They will invite a small group of pro-life leaders from across the country to march in Washington, DC this year. New Mexico Legislature – Issues on the Horizon

New Mexico’s 55th legislative session will be novel in some ways and familiar in others. The legislature has limited in-person public testimony at the Capitol due to ongoing health concerns, planning to conduct hearings via video conferencing. Though, many of our legislative priorities will be very familiar.

Assisted Suicide
Once again, physician-assisted suicide is on the table, filed as HB 47—The Elizabeth Whitfield End-of-Life-Options Act. It is currently in the House Committee on Health, & Human Services and is expected to have a hearing soon.

HB 47 would legalize assisted suicide in New Mexico by allowing patients to obtain lethal drugs from medical professionals who do not even have to be doctors – this is essentially Non-Physician assisted suicide. This legislation would also enable the same non-physicians to determine the mental capacity of patients requesting lethal drugs. It would take the extra step of forcing doctors and medical professionals to violate their conscience by mandating that they refer patients for assisted suicide when requested, regardless of the patient’s mental or medical condition.

HB 47 lacks many safeguards found in other states that protect patients from dangerous abuse and coercion from predatory family members and profit-driven insurance companies, putting the disabled and the elderly at particular risk.

Abortion
Although it has not yet been introduced, we expect another substantial effort to repeal abortion statute protections for women and doctors. Governor Michelle Lujan Grisham has reiterated her commitment to supporting legislative efforts to remove all abortion-related laws from New Mexico statutes, including those that provide doctors’ conscience protections and require a woman’s consent before having an abortion.

Marijuana
Lawmakers will likely introduce legislation to legalize recreational marijuana, again with support from the Governor’s office (a proposal 63% of New Mexicans opposed just a year ago). Supporters claim legalization will bring in tax revenue but dismiss the heavy cost legalization would have on our communities, particularly our children and communities of color, not to mention the health and safety risks that have become realities in other states which have legalized recreational marijuana.

Despite these radical efforts, we are proud we have strong allies in our state capitol we can stand alongside and support—Elected officials who are committed to representing your values.
