Washington, DC (March 17, 2016) Congressman Pearce issued the following statement after the House passed House Resolution 639, Authorizing the Speaker to Appear as Amicus Curiae on Behalf of the House of Representatives:

 

Separation of powers has defined our democracy for generations.  However, this President too often steps beyond these bounds and now the people are fighting back.  For the first time in history, Congress is voting to weigh in, as a whole, on a court case. The President does not write the law, Congress does. This amicus brief opposes the President’s unilateral action on immigration that  side-stepped the American people and their elected representatives. I believe we are a government, a Congress, for the people and by the People.  This amicus brief defends that belief,” said Congressman Pearce.

 

  1. Res 639 authorizes Speaker Paul Ryan to file a brief on behalf of the House defending Congress’ Article I powers.  The House of Representatives got involved after the Supreme Court asked whether the President violated the Take Care Clause.  This clause mandates the president “take care the laws be faithfully executed.”  This brief was filed after federal courts blocked implementation of the President’s executive order that would grant citizenship to thousands of illegal immigrants.  Texas and 25 other states have challenged the law.
