NM Supreme Court Changes the Laws on Marriage

law-gavelThe New Mexico Supreme Court has overturned a century of marriage law as it has suddenly found rights that judges have apparently missed.

The state Supreme Court declared state marriage laws unconstitutional and upheld New Mexico county clerks’ decisions to issue marriage licenses to same-sex couples. This despite the fact that the clerks took the law into their own hands and ignored very specific laws.

“We hold that the State of New Mexico is constitutionally required to allow same-gender couples to marry and must extend to them the rights, protections, and responsibilities that derive from civil marriage under New Mexico law,” Justice Edward L. Chavez wrote in the decision.

The court is legislating from the bench and rewriting law,exercising authority that the state constitution does not give. The state Supreme Court will now define “civil marriage” as the voluntary union of two persons to the exclusion of all others.

In addition, all rights, protections, and responsibilities that result from the marital relationship shall apply equally to both same-gender and opposite-gender married couples.

“Procreation has never been a condition of marriage under New Mexico law, as evidenced by the fact that the aged, the infertile, and those who choose not to have children are not precluded from marrying,” the justices wrote.

This was not surprising given recent decisions by the court that upheld homosexual rights above even the US constitution.

Update:

It is being reported that the NM Supreme Court ruling stipulates religious clergy will not be required to perform same-sex marriage ceremonies. But again, by what authority can the court make such a stipulation. They are not a legislative body.

Today the New Mexico Supreme Court released their ruling which redefines marriage to mean something it was never meant to be. The unfortunate affects this will have on society are sweeping. The court chose to issue a mandate and tear down an important pillar of our society– the traditional family. This opens new opportunities for the traditional family to be undermined and our societies threads to be ravaged. -Chris Donnelly
